Service Agreement

PROVIDER

Diaspora Medias di Ndiaye Alioune, a sole proprietorship with registered office at Via Vittorio Bottego 15, 20132 Milano (MI), VAT IT04815490265, REA MI-2112516, hereinafter referred to as “Diaspora Services Italia”.

CUSTOMER

The customer identified at the time of purchase by the first name, last name and email address entered during checkout on the website diasporaservices.it.

Art. 1 — Subject of the Agreement

This agreement covers the provision of informational guidance services, support in completing administrative paperwork, and document assistance by Diaspora Services Italia for the Customer. Diaspora Services Italia does not provide legal advice, does not hold a power of attorney, and does not act on behalf of the Customer before public or private entities.

Art. 2 — Provider’s Obligations

Diaspora Services Italia undertakes to: (a) provide the Customer with the information and document support agreed upon at the time of purchase; (b) comply with the timeframes indicated in the description of the purchased service, except in cases of force majeure or delays attributable to third parties (public bodies, consular offices, postal operators); (c) process the Customer’s personal data in compliance with Regulation (EU) 2016/679 (GDPR) and Italian data protection law.

Art. 3 — Customer’s Obligations

The Customer undertakes to: (a) provide complete, truthful and up-to-date information necessary for the provision of the service; (b) actively cooperate with Diaspora Services Italia, providing the documentation and clarifications requested within the specified timeframes; (c) make payment in accordance with the terms set out in Art. 4. Diaspora Services Italia shall not be held responsible for delays or inability to provide the service resulting from incomplete or incorrect information provided by the Customer.

Art. 4 — Payment Terms

The fee for the service is indicated at the time of purchase on the website diasporaservices.it and must be paid in full using the electronic payment methods available on the platform. The service is activated only upon confirmation of payment. Installment payments are not available unless explicitly stated otherwise on the page of the purchased service.

Art. 5 — Duration and Withdrawal

This agreement is limited in duration to the performance of the purchased service. The Customer may request withdrawal within 14 days of purchase, pursuant to D.Lgs. 206/2005 (the Italian Consumer Code), unless performance of the service has already begun with the Customer’s express consent, in which case the right of withdrawal is reduced in proportion to the part of the service already performed.

Art. 6 — Liability and Limitations

Diaspora Services Italia operates as a private party providing informational guidance and document support, with no guarantee as to the outcome of administrative procedures handled by third-party entities. Diaspora Services Italia is not liable for decisions, delays, or outcomes falling under the responsibility of public administrations, embassies, consulates, or other public or private bodies.

Art. 7 — Governing Law and Jurisdiction

This agreement is governed by Italian law. For any dispute relating to its interpretation, performance or termination, the Court of Milan (Foro di Milano) shall have exclusive jurisdiction, unless otherwise provided by mandatory law protecting the consumer.

Art. 8 — Acceptance of the Agreement

This agreement is deemed to be tacitly accepted by the Customer upon payment of the fee through the website diasporaservices.it, with no need for a separate handwritten or electronic signature. Payment constitutes full acceptance of all the clauses set out above.

Date of acceptance: corresponding to the date and time of payment confirmation shown on the receipt sent to the Customer.
